The National Housing Trust (NHT) is seeking to identify a Legal Counsel - Litigation, for its Legal Services Department. The incumbent will be responsible for securing the interest of the NHT by enforcing the provisions of the NHT Act against delinquent contributors and carrying out the prosecution or defence of lawsuits on behalf of the NHT.
Main duties
- Developing strategies that facilitate the prudent and efficient management of the NHT’s legal affairs
- Initiating legal action and/or representing the NHT (or any related party as instructed) as counsel (instructing and/or advocating) in legal proceedings (including but not limited to compliance matters) in Jamaica and in any tribunal/forum necessary; and liaising with the parties concerned as appropriate
- Conducting legal research, reviews and assessments; providing legal opinions, strategies and advising NHT’s board, and management on legal/litigation matters
- Preparing, filing and servicing all legal processes/documentations such as pleadings, summonses, affidavits and obtaining hearing dates
- Preparing submissions and written skeleton arguments for litigation matters assigned before any tribunal and reviewing all evidentiary documents in support of the NHT’s legal and factual positions
- Conducting all necessary pre- and post-trial activities including interviews with potential witnesses and enforcement
- Reviewing relevant payment advice and monitoring the payment process in keeping with established budgets, policies, standards and procedures
- Assisting with the preparation and/or review of contracts and/or agreements as assigned by the Assistant General Counsel or General Counsel
- Preparing various reports and conducting any other relevant litigation function that may be required from time to time
- Supervising direct reports and managing assigned portfolio(s).
Required Knowledge of:
- Laws and practices governing compliance enforcement activities
- Civil/litigation practice and procedure
- Acts, including Tax Collection, Income Tax, Justice of the Peace, Judicature (Parish Court & Supreme Court, Appellate Jurisdiction) and Revenue Administration; Parish Court Rules, Civil Procedure Rules, and Court of Appeal Rules
- Risk management, accounting, supervisory management, records/database management and customer service principles and practices
- Microsoft Office Suite and other relevant databases/systems.
QUALIFICATIONS AND EXPERIENCE
The successful candidate must have:
- Certificate of Legal Education
- Bachelor of Laws (LLB)
- Practising attorney-at-law, with at least six years’ membership at the Jamaican Bar
- At least five years’ experience in a similar capacity and as a civil/commercial litigator in several courts of Jamaica.
N.B. Supervisory management would be an asset
